Liability Waiver

Upon arrival, you and each member of your group will be asked to sign an indemnity form. By signing this form, you acknowledge and agree that you understand there are inherent risks involved when staying at a wild safari destination such as Chitembe River Lodge. Please carefully review the following:

Waiver and Release

In consideration of being permitted to participate in activities and lodge at Chitembe River Lodge, I agree to the following waiver and release:

I acknowledge that fishing and lodging within Mana Pools National Park, Zimbabwe, involve inherent risks, hazards, and dangers that cannot be eliminated, especially in a wilderness environment.

I UNDERSTAND THAT THESE RISKS, HAZARDS, AND DANGERS INCLUDE, BUT ARE NOT LIMITED TO:

• Water hazards associated with boating and wading in rivers, including the risk of drowning;

• Injuries from fishing equipment and interactions with other participants;

• Encounters with wildlife, animals, and insects.

I confirm that I understand these risks and have had the opportunity to discuss them with representatives of Chitembe River Lodge.

I recognize that these activities require a certain level of physical fitness, skill, and knowledge, and I believe I possess the necessary conditioning and ability to safely participate.

I VOLUNTARILY ACCEPT AND ASSUME ALL RISKS OF INJURY, PARALYSIS, OR DEATH arising from my participation in these activities and use of lodge services.

Release of Liability

On behalf of myself, my heirs, successors, executors, and assigns, I hereby knowingly and intentionally waive, release, indemnify, and hold harmless Chitembe River Lodge, its directors, shareholders, officers, agents, employees, and volunteers from any and all claims, demands, liabilities, causes of action, suits, or expenses (including attorneys’ fees) arising out of or related to my participation in activities at the lodge. This includes claims resulting from negligence, whether foreseen or unforeseen, directly or indirectly causing injury, paralysis, death, or property damage.

I further agree not to sue Chitembe River Lodge or related parties for any injury, paralysis, or death arising from my participation.

Governing Law

Any disputes or claims related to this agreement, including those involving illness, injury, or death, shall be governed by the laws of Zimbabwe. Any legal action must be filed within Zimbabwe.

I HAVE READ THIS AGREEMENT CAREFULLY, FULLY UNDERSTAND ITS CONTENTS, AND SIGN IT VOLUNTARILY, RECOGNIZING IT AS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND CHITEMBE RIVER LODGE AND ITS AFFILIATES.
