​Liability Waiver

 Upon arrival, you and each member of your group will be asked to sign an indemnity form. In signing this form, you warrant and represent to us that you are aware there are some obvious risks when staying at a wild safari destination and acknowledge as well as agree with the following noted below:

In consideration of my being permitted to participate in the activities of and lodge in the facilities at CHITEMBE RIVER LODGE, I agree to the following Waiver and Release:

I acknowledge that fishing and lodging in Mana Pools National Park of Zimbabwe has inherent risks, hazards, and dangers for anyone, that cannot be eliminated, particularly in a wilderness environment.

I UNDERSTAND THAT THESE RISKS, HAZARDS, AND DANGERS INCLUDE, WITHOUT LIMITATION:

Water hazards in boating and wading in the rivers, including drowning;

Injuries from fishing equipment and other participants;

Encounters with wildlife, animals, and insects;

I understand the risks, hazards, and dangers of fishing and any other activities offered at Chitembe River Lodge and have had the opportunity to discuss them with CHITEMBE RIVER LODGE. 

I understand that these activities may require good physical conditioning and a degree of skill and knowledge. I believe I have proper physical conditioning and the degree of skill and knowledge necessary for me to engage in these activities safely. I AM VOLUNTARILY USING THE SERVICES OF CHITEMBE RIVER LODGE WITH FULL KNOWLEDGE OF THE INHERENT RISKS, HAZARDS, AND DANGERS INVOLVED AND HEREBY ASSUME AND ACCEPT ANY AND ALL RISKS OF INJURY, PARALYSIS, OR DEATH.

Lastly, I, for myself, my heirs, successors, executors, and subrogees, hereby KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE, INDEMNIFY, AND HOLD HARMLESS, CHITEMBE RIVER LODGE, their directors, shareholders, officers, agents, employees, and volunteers from and against any claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorneys’ fees) which are related to, arise out of, or are in any way connected with my participation in this activity including, but not limited to, NEGLIGENCE of any kind or nature, whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, or death to me or my property as a result of my engaging in these activities or the use of these services, animals or equipment, whether such damage, loss, injury, paralysis, or death results from the negligence of CHITEMBE RIVER LODGE or from some other cause. I, for myself, my heirs, successors, executors, and subrogees, further agree not to sue CHITEMBE RIVER LODGE due to any injury, paralysis, or death suffered in connection with my use and CHITEMBE RIVER LODGE participation in the activities thereof.


Controlling Law 
Any controversy or claim arising out of or relating to this Agreement or the performance thereunder, including without limitation any claim related to the illness, injury, or death, shall be governed by Zimbabwean law. Any lawsuit filed due to my participation in the CHITEMBE RIVER LODGE shall be filed in Zimbabwe.

I HAVE CAREFULLY READ, CLEARLY UNDERSTAND, AND VOLUNTARILY SIGN THIS WAIVER AND RELEASE AGREEMENT. I am aware that this is a release of liability and a contract between myself and the CHITEMBE RIVER LODGE, their affiliated agencies, their employees, directors, shareholders, and the supplier of the facilities and equipment I will use during my participation in CHITEMBE RIVER LODGE.
